These Terms of Use (“Terms”) apply to the websites www.annachy.com and the corresponding mobile applications (collectively, “Platforms”) managed and operated by Super Saravana Stores Emart Private Limited (“Annachy,” “Company,” “we,” “us,” “our”). By accessing or using the Platforms or any services or functionalities offered (“Service”), you (“User,” “you,” “your”) agree to be bound by these Terms, as updated from time to time.

Please review these Terms of Use and any additional terms (“Additional Terms”) applicable to specific Services or Products (defined below). If there is a conflict between these Terms of Use and the Additional Terms, the Additional Terms will control.

PART A – TERMS AND CONDITIONS FOR USAGE OF THE PLATFORMS

1. General

The Platforms allow you to discover, select, and purchase various products from serviceable locations.
We may modify these Terms of Use at any time. Review them regularly to stay informed.
Using the Platforms indicates your agreement to these Terms, the Privacy Policy, the Cancellation, Returns and Refund Policy, and any other applicable policies (collectively, “Agreement”).
You are granted a limited, revocable permission to access and use the Platforms.

2. Eligibility

By accepting these Terms, you affirm that you are 18 years or older and fully competent to enter into this Agreement.
Minors under 18 must use the Platforms under parental or legal guardian supervision.

3. Account Registration

Registration is required to purchase products or use Services and is free.
You can register via mobile OTP.
You are responsible for maintaining account confidentiality and restricting device access.
Notify us immediately of any unauthorized account use.

4. Communication and Unsubscription

By registering, you consent to receive communications from us (per applicable telecom regulations).
You may unsubscribe from marketing communications at any time as instructed in such communications.

5. Access to Data

By accepting these Terms, you consent to our accessing your device’s camera and gallery solely to provide Services.
You are responsible for any content you upload; you must not upload anything that is unlawful, infringes rights, or is otherwise prohibited.

6. Disclaimer of Warranties, Inaccuracies or Errors

We strive for accuracy but do not guarantee completeness, reliability, or error-free operation.
The Platforms and Services are provided on an “as is” basis without warranties of any kind.
Visual representations of products may not exactly match delivered products.

7. Availability and Accessibility

The Platforms are operated from India. Use outside India is at your own risk and subject to local laws.
Fraudulent activities or violations of these Terms may result in account deletion and legal action.

8. Third-Party Interactions

Any dealings with third parties (advertisers, sponsors, linked sites) are solely between you and such third parties. We have no liability for third-party sites or products.

9. Copyrights and Intellectual Property

All content on the Platforms (“Annachy Content”) is protected by intellectual property laws.
Limited, revocable, personal, non-exclusive, non-transferable license granted for personal use only.
You may not copy, modify, distribute, or use content for commercial gain.

10. License and Use of Content Provided by User

By posting on the Platforms, you grant us a royalty-free, perpetual, irrevocable license to use such material.
We reserve the right to monitor and remove inappropriate content and cooperate with law enforcement.

11. User Warranties and Restrictions

You warrant all information provided is true and lawful.
Prohibited activities include: unauthorized modifications, illegal use, introducing viruses, account hacking, and posting prohibited or harmful content as listed in these Terms.

12. Indemnification and Limitation of Liability

You indemnify us and our representatives from all claims arising from your use of the Platforms, violation of these Terms, or infringement of rights.
Our liability is excluded to the fullest extent permitted by law.

13. Fees and Payment Options

Browsing the Platforms is free; Annachy may elect to implement fees in the future.
Payment methods include net banking, cards, cash on delivery, wallets, EMI, and other options as specified.
Payments are subject to acceptance and verification. Annachy may reject or delay any transaction.
Errors in pricing may be rectified with refunds or payment adjustments per process described.

14. Promotions and EMI

Promotional credits may be issued per event and at Annachy’s discretion.
EMI options available for select banks per their terms.

15. Access Outside India

You are responsible for compliance with applicable laws when accessing the Platforms outside India.

16. Governing Law and Jurisdiction

These Terms are governed by Indian law. Courts of Chennai, India have exclusive jurisdiction.

18. Force Majeure, Waiver, Severability, Amendment, Miscellaneous

We are not liable for delays or failures due to events beyond our control (“force majeure”).
No waiver of any provision unless in writing.
Invalid provisions are severable without affecting the remainder.
Terms may be amended or updated at our discretion.
Your use of third-party services is at your own risk.

PART B – TERMS AND CONDITIONS OF SALE ON THE PLATFORMS

1. Contract of Sale

Product listing is an invitation for you to make an offer. Placing an order is your offer to purchase.
Sale contract is concluded only upon shipment/disptach of the product and delivery confirmation.
Product delivery is free for orders above INR299.
Tracking details and invoices will be sent to your registered contact details.
All orders must be for personal/internal use only, and within normal household quantities.
Product availability is not guaranteed until confirmed.

2. Returns and Refunds

3. Product Availability and Pricing

Product availability is listed on the relevant webpage.
All prices are in Indian Rupees and inclusive of taxes.
Prices in your shopping cart may change before placing the order; only the price at the time of order is applicable.

4. Licenses

You are responsible for obtaining any required licenses for certain Products.

5. Taxes

You are responsible for paying all required taxes associated with purchases.

6. Eligibility

Only individuals legally capable of contracting (18 years or older, etc.) may use the Platforms to buy products.
Minors may only purchase with parental consent.

7. Limitation of Liability

Our maximum liability is limited to the product purchase price in question.
We are not responsible for indirect, incidental, or consequential losses.

8. Amendments

We may update our policies or Terms of Sale at any time.
You are subject to the current Terms as of your purchase date.

9. Force Majeure, Waiver, Governing Law

Not liable for delays/failures due to causes beyond our control.
Waiver only in writing.
Courts of Chennai, India, have exclusive jurisdiction.
Indian law applies.
